Terms of Service

These Terms of Service are an agreement between you and GrowMeOrganic LLC, operating as CommentWatchDog ("we", "us", "our"), covering your use of commentwatchdog.com and app.commentwatchdog.com (together, the "Service"). By creating an account or using the Service you accept these terms. If you are accepting on behalf of a company, you confirm you have the authority to bind it.

1The Service#

CommentWatchDog moderates and manages comments and messages on Facebook pages and Instagram professional accounts you connect, using Meta's official APIs. Moderation actions such as hiding, deleting, replying and blocking are performed on your instruction, whether given manually, through rules and automations you configure, or through AI agents you enable. You remain responsible for the moderation policy you set.

The Service also includes DM automation: automations and flows you build that send public replies and direct messages for the pages you connect, ask the questions you set, keep a contact list, and can send requests to web addresses you configure. These run on your instruction in the same way, and you remain responsible for what your automations send and ask. An AI agent answers from the knowledge and the instructions you give it; you are responsible for both, and an AI-written answer may contain mistakes.

2Your account#

• You must be authorized to manage the Facebook pages and Instagram accounts you connect.
• Keep your credentials confidential. You are responsible for all activity under your account.
• You may invite team members and control their roles. Their actions in your workspace are your responsibility.
• You must provide accurate account information and keep it current.

3Acceptable use#

You may not use the Service to:

• violate any law, Meta's terms, or the rights of others;
• send spam or unsolicited messages, or automate deceptive engagement;
• harass, threaten or defame any person;
• attempt to access other customers' data or probe the Service's security;
• resell or sublicense the Service without a written agreement with us.

For automated messaging in particular: you follow Meta's rules for messaging on Messenger and Instagram, and where the law that applies to you requires a person's consent before you message them or collect their email address or phone number, you obtain it. The Service sends an automated message only in response to something a person did, such as commenting, sending a message or tapping a button, and it skips a person who writes "stop". That design does not replace your own duty to comply.

We may suspend accounts that do, and where the law requires it we may report abuse to the relevant authorities.

4Plans, trials and billing#

• New accounts get a 7-day free trial with no card required, including 250 comment credits. When the trial ends or its credits are used without a subscription, moderation and Post cleanup pause; your data is kept.
• Paid plans are billed monthly or annually through Stripe, in advance. They differ by monthly comment volume and by what each includes: pages, team members, features and how long history is shown. Prices and inclusions are listed on the pricing page.
• Volume is measured in comment credits. A comment consumes one credit the first time the Service processes it: automatically when live moderation checks an incoming comment within the scope you set for that page (ads, posts or both), or in Post cleanup when you run a check or take your first action on a loaded post. Comments outside that scope, and automations, use no comment credits. A billed comment is not billed again, whichever surface billed it first (a comment billed by live moderation is free in Post cleanup), except that re-running a check after you change moderation settings counts those comments again; the exact cost is shown before you confirm. Loading and browsing a post in Post cleanup is free. The full rules with examples are at How comment credits work.
• Subscriptions renew automatically at the end of each billing period until canceled.
• Upgrades take effect immediately with prorated billing. Downgrades take effect at the end of the paid period.
• When an account uses more pages, team members, AI agents or automations than its plan includes, for example after a downgrade or when a trial ends, the ones beyond the plan are paused, not deleted, and come back on an upgrade. Data older than a plan's history window is kept and shown again on an upgrade.
• Fair use of unlimited contacts and DMs: on plans that include them, your automations may reach any number of people and send any number of direct messages, with no charge per person. This is meant for the normal use of your own pages. As a guide, an account whose automations reach more than 100,000 different people in a month is above normal use; we will contact you to agree a suitable plan before changing anything, and automations are not stopped automatically. Automated messaging that breaks section 3 (Acceptable use) or Meta's rules is not covered and may be limited or suspended.
• If your volume regularly exceeds your plan, we will ask you to upgrade; we do not charge overage fees silently.
• Prices may change; existing subscriptions are notified at least 30 days before a change affects them.

5Cancellations and refunds#

Cancellation is self-serve and never restricted: at any time, open Settings and Account in the app and cancel through your Stripe customer portal. No contact with support is required, there are no retention steps, and we never delay or gate a cancellation. The dashboard is the cancellation channel; a cancellation is complete the moment you confirm it there. Cancellation takes effect at the end of the paid period; until then the Service keeps working normally. After that, moderation pauses and your data is kept until you delete it.

The free trial requires no payment method, so no charge can occur during a trial. Payments are otherwise final and non-refundable to the maximum extent permitted by law, as set out in the Refund Policy; we do not issue partial refunds for unused time. If you believe you were billed in error, contact support@commentwatchdog.com within 30 days of the charge and we will look at it properly.

6Third-party platforms#

The Service depends on Meta's APIs. Actions Meta declines or limits, for example rate limits or temporary spam protections, are shown to you truthfully in the app; we cannot override them. Your use of Facebook and Instagram remains governed by Meta's own terms. We are not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc.

7Your content and data#

Your content stays yours. We claim no ownership over your pages, posts, comments, replies, messages, contact list, or configuration. Our handling of personal data is described in the Privacy Policy, including how to delete everything at any time.

For business customers subject to the GDPR or similar laws: for the data of the people who comment on or message your pages, your contact list included, that we process on your instructions, you are the controller and we act as your processor. Our Data Processing Agreement applies automatically to that processing and is part of these terms; a countersigned copy is available on request.

8Intellectual property#

The Service, including its software, design and branding, belongs to GrowMeOrganic LLC and its licensors. Your subscription gives you a limited, non-exclusive, non-transferable right to use the Service for your own business while these terms are in effect. You may not copy, modify, reverse engineer or create derivative works of the Service except where the law permits it regardless of this clause.

9Feedback#

If you send us ideas or suggestions, we may use them to improve the Service without restriction or obligation to you. We will never name you publicly in connection with feedback without your permission.

10Early-access features#

Features labeled as beta, preview or early access are provided as-is, may change or be withdrawn without notice, and may be subject to additional limits. We welcome feedback on them, and we exclude them from any reliability expectations set elsewhere in these terms.

11Availability and changes#

We aim for the Service to be fast and reliable, but it is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We may improve or change features over time. If we discontinue the Service entirely we will give at least 30 days notice and a way to export your data.

12Liability#

To the maximum extent the law allows, our total liability for all claims related to the Service is limited to the amount you paid us in the 12 months before the first claim arose. We are not liable for indirect, incidental, special or consequential damages, loss of profits or data, or for the content third parties post to your pages. Nothing in these terms excludes liability that cannot be excluded by law.

13Indemnity#

You will defend and indemnify us against third-party claims arising from your content, your moderation policy, or your use of the Service in breach of these terms or of applicable law, including reasonable legal fees. We will notify you promptly of any such claim and let you control the defense, provided it does not require us to admit fault.

14Termination#

You can delete your account at any time in Settings; this removes your data as described in the Privacy Policy. We may suspend or terminate accounts that breach these terms; where practical we will warn you first and give you a chance to fix the problem. Sections that by their nature should survive termination, including sections 7, 8, 12, 13 and 15, survive it.

15Governing law and disputes#

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. The contracting entity is GrowMeOrganic LLC, 30 N Gould St STE R, Sheridan, WY 82801, United States.

Before starting any formal dispute, contact us at support@commentwatchdog.com; most issues are resolved quickly and informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Wyoming, and both parties consent to their jurisdiction.

16General#

• Entire agreement. These terms, the Privacy Policy and your order through Stripe are the entire agreement between us about the Service.
• Severability. If any part of these terms is found unenforceable, the rest stays in effect.
• No waiver. Not enforcing a provision is not a waiver of the right to enforce it later.
• Assignment. You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets, with notice to you.
• Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
• Notices. We send notices to your account email. Legal notices to us go to support@commentwatchdog.com.

17Changes to these terms#

We may update these terms as the Service evolves. For material changes we will notify you by email or in the app at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated terms; if you do not, cancel before they take effect.
